1. Acceptance of Terms

By creating an account or using Pass It On in any way, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

Pass It On is an estate planning platform available at passiton.now as a web application and iOS app. It helps you document personal property, assign beneficiaries, and generate estate planning reference documents.

Important: Pass It On is a documentation and organizational tool only. It is not a substitute for professional legal advice, a will, a trust, or any legally binding estate planning instrument. Nothing generated by this service constitutes legal advice or a legally enforceable document. You should consult a qualified estate planning attorney for your actual estate planning needs.

3. Account Registration

To use Pass It On, you must:

  • Provide a valid email address and verify it before accessing the service
  • Be at least 18 years of age
  • Maintain only one account per person
  • Keep your password and recovery phrase confidential and secure

You are solely responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@passiton.now.

4. Zero-Knowledge Encryption

Pass It On offers optional zero-knowledge encryption. When you enable this feature, your data is encrypted on your device before it is transmitted to our servers. This means:

  • We cannot read your encrypted data
  • We cannot recover your data if you lose both your password and your 12-word recovery phrase
  • There is no "forgot password" recovery path for encrypted accounts without your recovery phrase

By enabling encryption, you accept these risks fully and acknowledge that data loss from losing your credentials is your sole responsibility. Store your recovery phrase somewhere safe and offline.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable law
  • Attempt to circumvent, disable, or interfere with any security features of the service
  • Upload or transmit malicious code, viruses, or any content designed to harm others
  • Abuse, overload, or attempt to exploit rate limits or API endpoints
  • Create accounts for bots, scrapers, or automated systems without our written permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

Violations may result in immediate account suspension or termination.

6. User Content and Data Ownership

You retain full ownership of all content you create within Pass It On, including items, beneficiary assignments, photos, and notes. We claim no intellectual property rights over your content.

By using the service, you grant Pass It On a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely as necessary to provide the service to you. This license ends when you delete your content or your account.

We will not sell your content or use it for advertising purposes.

7. Third-Party Services

Pass It On uses hCaptcha, provided by Intuition Machines, Inc., to protect the service from automated abuse. By using Pass It On, you are also subject to:

8. Account Deletion

You may delete your account at any time from your account settings. Deletion works as follows:

  • When you request deletion, a 30-day grace period begins
  • During this period, you may cancel the deletion and restore your account
  • After 30 days, your account and all associated data are permanently and irreversibly deleted from our systems
  • We cannot recover your data after permanent deletion

We recommend exporting your data before requesting deletion. Export is available from your account settings.

9. Limitation of Liability

We provide Pass It On as-is. We do our best to keep it reliable and accurate, but we cannot guarantee it will always work perfectly or be available without interruption.

Specifically, Pass It On is not liable for:

  • Any legal consequences arising from reliance on documents or information generated by this service
  • Loss of data, including data lost due to forgotten credentials when encryption is enabled
  • Indirect, incidental, special, consequential, or punitive damages of any kind
  • Any interruption or unavailability of the service

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, our total liability to you for any claims arising from your use of the service shall not exceed the amount you have actually paid us in the twelve months preceding the claim.

You should not rely solely on Pass It On for estate planning. Consult a qualified estate planning attorney.

10. Service Availability

We aim for high availability but do not guarantee uninterrupted access to the service. We may perform scheduled or emergency maintenance. Where possible, we will provide advance notice of scheduled downtime. We reserve the right to modify, suspend, or discontinue features of the service at any time, with or without notice.

11. Termination

You may terminate your account at any time by deleting it through your account settings.

We may suspend or permanently terminate your access to the service without prior notice if we determine, in our sole discretion, that you have violated these terms, engaged in fraudulent activity, or posed a risk to other users or the integrity of the service.

Upon termination, your right to use the service ceases immediately. Sections of these terms that by their nature should survive termination will do so, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Changes to These Terms

We may update these Terms of Service from time to time. The updated version will be posted at passiton.now/terms with a revised "Last updated" date. For material changes, we will notify you by email or through an in-app notice before the changes take effect.

Your continued use of Pass It On after changes take effect constitutes your acceptance of the revised terms. If you do not agree to the updated terms, stop using the service and delete your account.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms or your use of the service shall be resolved in the state or federal courts located in California.
